教育目標

This course "Talking on Modern Rights"（比較憲法） will provide a comparative perspective on civil rights in different states and international contracts, the course will explore the historical foundation and contemporary challenges of basic rights through a comparative lens, focusing on the Constitution of United States and the Basic Law “Grundgesetz” of Germany. Starting with the philosophical explanation of natural rights, human rights and constitutional rights, the lecture will illustrate the tension between the is and the ought. The course will further examine specific constitutional protections in the U.S. Bill of Rights and the German Grundgesetz, national protection of rights that are anchored alongside international treaties and human rights conventions. Basic rights such as freedom of speech, freedom of religion, protection of property will be analyzed across different constitutional systems, against the background of contemporary menace to these rights such as digital surveillance, climate change, disinformation, and the rise of populism. By the end of the semester, students will have gained a critical understanding of civil rights and the diversity of constitutional traditions, the theoretical understanding should then be proven by individual presentations and analysis of controversial cases. 比較憲法是一門從比較視角探討不同國家的公民權利與基本權利的課程。本課程全英文授課，將以美國憲法與德國《基本法》（Grundgesetz）為核心，追溯歐美憲法的歷史基礎，並討論其在當代社會所面臨的挑戰。課程首先從自然權利、人權與憲法權利的哲學基礎出發，說明「現實如何存在」與「規範應當如何」的議題。課程將進一步分析美國《權利法案》與德國《基本法》中具體的憲法保障。探討言論自由、宗教自由、財產權保障等基本權利，課程將在不同憲政傳統 中進行權利的比較和分析。學期結束時，學生將能夠批判性地理解公民權利的意義、基本權利保障的多樣性，以及不同憲法傳統如何回應現代社會的政治與法律挑戰。學生也將透過個人報告與爭議案例分析，將理論理解轉化為具體的判斷能力。
